1. Acceptance of Terms
By accessing or using the TicTag platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including administrators, form creators, and form respondents.
2. Description of Service
TicTag is a digital forms and workflow platform that enables users to create, distribute, and manage mobile forms, collect data including text, images, signatures, and GPS coordinates, and generate reports. The Service is provided as a progressive web application accessible via modern web browsers.
3. Account Registration
To use certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
4. Acceptable Use
You agree not to use the Service to: upload or transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable; impersonate any person or entity; interfere with or disrupt the Service or its infrastructure; attempt to gain unauthorised access to any systems or data; or use the Service for any purpose that violates applicable local, national, or international laws.
5. Intellectual Property
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, software, and design — are the exclusive property of TicTag and are protected by South African and international copyright, trademark, and intellectual property laws. You retain ownership of any data or content you submit through the Service.
6. Data Ownership & Storage
You retain full ownership of all data submitted through forms created on the platform. TicTag acts as a data processor on your behalf. We store your data on secure servers and implement reasonable technical and organisational measures to protect it. You may request export or deletion of your data at any time by contacting support.
7. Subscription & Payment
Certain features of the Service require a paid subscription. All fees are quoted in South African Rand (ZAR) unless otherwise stated. Subscriptions renew automatically unless cancelled before the renewal date. TicTag reserves the right to change pricing with 30 days' written notice. Refunds are handled on a case-by-case basis.
8. Service Availability
We strive to ensure the Service is available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. TicTag shall not be liable for any loss or damage arising from service interruptions.
9. Limitation of Liability
To the maximum extent permitted by law, TicTag and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall remain in effect, including ownership, warranty disclaimers, and limitations of liability.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
12. Changes to Terms
TicTag reserves the right to modify these Terms at any time. Material changes will be communicated via the Service or by email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
